For me this is a very nuanced issue. First I agree with Commissioner Verstager that companies (all companies large and small) pay their fair share of tax and she is trying to use her power to ensure that happens. On one level, this is a global issue and can really only be sorted globally probably through the OECD, nonetheless the EU can and should take a lead.

In fact the EU has been doing this with new legislation around mandatory exchange of information between Member States. We are also in the final stages of ensuring what we call "country by country reporting" – another way to ensure greater transparency in the tax dealings of multinational companies.

As always there is a but, that comes down to the question – Is Commissioner Vestager exceeding her powers as Commissioner, is she interfering in the right of sovereign Member States to manager their tax affairs? That is why the European Court of Justice must adjudicate on the matter.

Yes it's tempting to say take the money but it's worth it to wait for 12-18 months for the court judgement. Then of course if the court sides with the Commissioner the real battle will begin as various different countries look for their slice of the cake.
